Changes to the Status Certificate
Well, just when you were starting to get comfortable with the new condo forms, the province has issued a new Status Certificate. Fear not: the new Status Certificate contains very minor changes, all of which are required to address the recent regulatory changes related to Electric Vehicle Charging stations.
Changes to the Status Certificate
On March 26, 2018, the province issued new regulations under the Condo Act to facilitate the installation of electric vehicle charging stations in condominium corporations. These regulations will take effect on May 1, 2018.
The implementation of these new regulations required some amendments to the Status Certificates. More specifically, paragraphs 23, 25 and 33 of the Certificate have been amended to provide for the possibility that common elements may be modified (either by the Corporation, or by owners through a section 98 agreement) to allow for the installation of such electric charging stations. Such installations, whether they have been implemented or are being contemplated, must be disclosed in the Status Certificate. Should the installation of such charging stations be the result of an owner’s initiative (through a section 98 agreement) a copy of the agreement must be disclosed with the Status Certificate.
When must you start using the new Status Certificate?
The new Status Certificate will only come into effect on May 1, 2018. Until then, you must continue to use the existing version of the form dated September 1, 2011. But come May 1st, 2018, you must switch to the new form. Keep in mind that the Status Certificate is a “prescribed form“, which means you must use the province’s most current version.
