What Happens if a Condo Directors does not Complete the Mandatory Training?

We were hoping you would not be asking that question. Who is opposed to apple pie? Ontario’s Condo Director Training is not only mandatory, its extremely useful, easy and free. But here it is, our post on what happens if a condo director fails to complete the required training within the set time.

Requirements and deadlines

The amended Condo Act mandates all condo directors in Ontario to take mandatory training.  This training must be completed within 6 months of the date at which directors are elected or appointed.

This requirement is only applicable to directors appointed or elected after October 31, 2017. If you were elected or appointed after that cut off date, you must take this training. If you were elected or appointed before, you can complete your term without taking the course.   But why would you? Knowledge is power.

This training is valid for 7 years.  Which means that you don’t have to necessarily retake the training when you get re-elected or re-appointed – as long as it has not been 7 years since you took the training.

Who provides the training?

For the time being, as far as we know, only the CAO has been designated to provide this training.  This means that training taken with other organizations (such as the Condo Director Group or the CCI) does not count towards this requirement.

What’s the training?

The training is an online course consisting of 21 modules. You can take them at your own pace, one at a time, or you can “CAO binge” and take them all in one sitting.  Each module take between 10 to 20 minutes to complete.  Taking the entire course takes approximately 3 to 6 hours.

The training includes modules on:

  • the role of directors
  • effective leadership
  • board meetings
  • requisitioned meetings
  • corporate records
  • reserve funds
  • audits
  • collections and liens
  • insurance
  • repair, maintenance and modifications
  • information certificates and status certificates
  • The Condo Authority and its Condo Tribunal….

There is no pass or fail exam, but there are regular quizzes that allow you to test your understanding of what you have learned to that point.

How much does the training cost?

Nothing. The training is provided by the CAO for free.

How do we know a director has completed the training?

Once you’ve completed the course, the CAO will email you a certificate, identifying you and the date at which you completed the course.

Directors having completed the course must forward their certificate of completion to the corporations for which they are directors within 15 days of having received their certificate.

The CAO must keep adequate records of this training completion. The director who completed the training, their corporation or persons authorized by them can examine or obtain copies of this record of completion.

Corporations would be well advised to also keep adequate records of this.

What happens if a Director does not take the training within 6 months?

Directors who do not complete the mandatory training within 6 months of their appointment or election will result in the CAO unleashing the four horsemen of the apocalypse onto their condo corporation.

OK. Not really but the consequences are comparable:

  • Horseman #1: A director who does not complete the training within the prescribed time will automatically be disqualified and automatically cease to be a director;
  • Horseman #2: The corporation must advise both the CAO and the owners of the change to the board within 30 days;
  • Horseman #3: Disqualified directors can no longer vote at board meetings or count towards quorum. This may result in the corporation loosing quorum, which would require that an owners meeting be called within 30 days;
  • Horseman #4: These fallen directors cannot be indemnified by the corporation against liability and costs as they lose the benefit of the indemnification provision of section 38 of the Act.
